Những vấn đề cần cân nhắc khi lập thỏa thuận tài sản vợ chồng trước hôn nhân
Thỏa thuận tài sản vợ chồng trước hôn nhân được quy định tại điều 47,48,49,50 luật HNGĐ 2014. Đây là một định chế rất có ý nghĩa về mặt thực tế trong bối cảnh kinh tế, xã hội hiện nay. Việc kết hôn, ly hôn hiện nay đều gắn với vấn đề tài sản, không như trước đây, tài sản và các vấn đề liên quan tới tài sản chỉ được giải quyết khi ly hôn.

Thỏa thuận tài sản vợ chồng mang ý nghĩa xác lập chế độ tài sản vợ chồng được pháp luật thừa nhận, hai bên phải tuân theo thỏa thuận đã xác lập đó, trừ khi thỏa thuận tài sản bị vô hiệu. Việc chia tài sản khi ly hôn cũng sẽ căn cứ vào thỏa thuận tài sản để giải quyết.
Thỏa thuận tài sản vợ chồng tác động đến nhận thức, cảm xúc của hai bên trước khi bước vào quá trình “thỏa thuận”, vì là vấn đề khó nói nên tốt nhất khi lập thỏa thuận tài sản, hai bên nên giao cho một bên thứ ba có kinh nghiệm để dự thảo tài liệu này.
Nếu có ý định xác lập một thỏa thuận tài sản vợ chồng trước hôn nhân, Hai Bên nên xem xét một số lợi ích cũng như những điều cần cân nhắc khi lập thỏa thuận tài sản.
1. Các lợi ích của việc lập thỏa thuận tài sản vợ chồng
Một thỏa thuận tài sản vợ chồng có thể tạo ra cho hai bên tâm lý yên tâm hơn trong việc quản lý và sử dụng tài sản trong thời kỳ hôn nhân. Nó giúp không làm gia tăng thêm yếu tố tranh chấp khi ly hôn vì các vấn đề liên quan đến tài sản sẽ được thực hiện và giải quyết thông quan thỏa thuận tài sản.
Sự rõ ràng (càng rõ ràng càng tốt) của thỏa thuận tài sản sẽ giúp tránh những xung đột, mâu thuẫn cá nhân có thể phát sinh trong thời kỳ hôn nhân, dẫn đến những hậu quả, hệ lụy không mong muốn.
2. Những vấn đề cần cân nhắc khi lập thỏa thuận tài sản vợ chồng
>> Tiết lộ số lượng và giá trị tài sản riêng của mỗi bên có trước thời kỳ hôn nhân. Đây có thể xem là vấn đề quan trọng hàng đầu của một thỏa thuận tài sản. Mỗi bên có quyền tiết lộ phạm vi tài sản riêng của mỗi bên có trước thời kỳ hôn nhân, trường hợp có che dấu thì các tài sản che dấu chưa được tiết lộ vẫn được xem là tài sản riêng nếu bên liên quan chứng minh được điều này. Các nghĩa vụ tài sản riêng trước hôn nhân chưa tiết lộ cũng không mặc nhiên được nhập thành nghĩa vụ chung của hai bên trong thời kỳ hôn nhân;
>> Các thỏa thuận tài sản riêng và tài sản chung (nếu có), VD tài sản mặc dù có trước thời kỳ hôn nhân nhưng do hai bên cùng làm ra thì vẫn là tài sản chung, thỏa thuận nhập tài sản riêng thành tài sản chung, tài sản riêng dùng xử lý trách nhiệm tài sản chung, đóng góp chi phí, chia tài sản trong hôn nhân, chia tài sản khi ly hôn …
>> Loại, nguồn gốc tài sản, VD tài sản hình thành từ việc kinh doanh riêng của mỗi bên vào trước thời điểm kết hôn, tài sản nằm trong tài sản chung với các bên thứ ba,…;
>> Thỏa thuận có gây ảnh hưởng đến tâm lý kết hôn hay không, nếu đã quyết định lập thỏa thuận, hai bên nên xem xét đến phạm vi thỏa thuận cũng như những nội dung cần đưa vào thỏa thuận;
>> Nghĩa vụ tài sản của mỗi bên hình thành trước thời kỳ hôn nhân có ảnh hưởng thế nào đến các lợi ích chung của gia đình và con cái sau khi kết hôn;
